Don't know what to do about this debt.

Here is the problem. When I was 18, I was sent those oh so lovely pre-approved cards that we all go nuts for. I maxed them out, young and dumb, and shortly after I lost my job. I was unable to make payments for almost 4 months. During that time, Chase Bank closed their credit card. About a year ago I begane making regular monthly payments with both of my credit cards and have been paying on time since last year. I have since paid off one of the credit cards. I recently tried to apply for a car loan and was told that my credit score is 586. :( There are 2 things I am not sure how to handle from here to get my credit score up.
1. Should I continue to pay on the Chase card every month or should I pay it off? How is the closed card effecting my credit?
2. On average how long does it take to raise your credit score & is there really anyway I will be able to, or is the damage irreversible.

Thank you for all your help. Any help or advice is welcome I am 21 and need to figure this out now.

When are credit reports updated?

- first, a question just for verifying the "obvious". Will changes applied to your credit profile by a CRA show on your credit report immediately?

- how long does it take for the credit bureau to apply received changes from your debtors to your credit report/profile?

- are there "cutoff" dates for updating (for example: changes received after 15th of month won't be reported until following month)?

- if the change is of sufficient magnitude (for example: home purchase or large loan balance payoff), will your credit score change immediately after CRA applies change to your report/profile?

- how long does it generally take before reconciled collections balances stop affecting your credit score (for both "paid in full" and "settled in full")?

- is there a rule of thumb to follow for the ratio of income-to-credit limit (for example: being laid off from high-paying job and having a $25k credit card limit with a new job salary of only $50k)?

- what's the rule of thumb for credit balance-to-limit ratio?

does short sale always affect credit?

My knowledge of how short sales work is not great, so please bear with me...

I'm interested in trying to do a short sale on my condo some time in the near future. For one thing, I don't even know if they will allow it since I don't have any problems making payments, and my income doesn't suggest that I will have any trouble in the near future. My only reason for wanting to short sell is just that I don't want to own the place anymore and am looking to move to a larger home due to a growing family. I was all set to pursue this, when I discovered that short sales have an extremely bad effect on your credit... But I'm wondering if this is always the case. I'm not looking for the kind of short sale where they 'forgive' part of the debt and don't make you pay it, but the kind where I make arrangements to pay the difference (like assuming it as a loan), or overborrow slightly on the new home we're looking to get, and cover the difference that way (this was an option I saw discussed somewhere else, I don't know how common it is for this to be allowed).

In either case, I wouldn't be short selling to avoid forclosure or get the bank to strike part of the loan owed, I'd be paying it back. In these cases will your credit still be affected at all by the fact that it's a short sale? Or would it not be considered a short sale since arangements are made to honor the original loan?

If I can't sell this place without taking a credit hit, that will be extremely bad news... I've just gotten my credit into the 720-740 range and was thinking how great that would be for the new home purchase... is there no possible arrangement to sell when upsidedown on a loan that won't kill your credit?...

Thanks

What Do We Do??

Hello Everyone.

I need help! My husband has a few things on his credit report that we are trying to fix. He disputed certain items only to be told that he does supposedly owe the money. He wrote and/or called each of the debt collectors that appear in hopes of finding out exactly what was owed and to get an itemized list of what the debts were for. Two of the debts are from universities that he attended and one is from a phone company.

After numerous calls and a letter or two, he still has not received anything back explaining what the debts are for. He has gotten letters basically saying, "you owe this amount and to pay it". He never received any bills prior to this, but only found out about the debts after checking his credit reports and he took it upon himself to reach out to the debt collectors to find out what/why he owes the money so that we can try to get it taken care of. Obviously, the debt collectors aren't helping us with this and we are NOT about to write out checks for things we are not even sure that we owe. We just want information about what/when the debts are from! If we truly owe the money, shouldn't the phone company and universities be able to provide that information to us? We want to do the right thing, but are getting nowhere!!!

What else can we do?

Thanks!

Unauthorized Funds withdraw by Collection Agency

In December 09 a collection agency charged by account $103.36 x3, without notice, without authorization, without anything. They claim they have the right to do this b'c I defaulted on an installment plan with their client (who was first party along with me to the installments.) I contacgted my bank. Wachovia decided it was okay for them to do this. I submit it is not okay for them to do this for the following reasons: 1) the first party Total Gym, LLC, provided no terms of credit or terms of installment. The only term disclosed is 14 consecutive payments with no provisions of what happens if a default occurs, assignments, rights, etc. The collection agency BYL Collections, was contacted by me in December, 2009 (same day I spoke with my bank) and I requested any and all information to veryify the debt- signtures, terms & conditions, how they obtained my SSN- I was not asked for nor did I provide this when I ordered from Totaly Gym, LLC the item.) Just to double check this, I went online to their website, began a "chat session" with an online representative who stated there are not terms or conditions of credit/ installment b'c they are not extending credit (I'm not sure this is accurate on thier part in the slightest. Even a check as payment for something is an instrument of extending credit.) Even withiin the 30 days I requested the validation of the debt and all information, BYL continued it's telephone calls to me. Note: I have not recieved a dunning letter from them with one exception. In the fall, they sent me a letter stating they would renegotiate the terms and lower monthly payments and all I had to do was "sign on the proverbial dotted line" to take advantage of thier offer.

I see a few different problems here. 1) BYL failed to validate the debt as requested. 2) I think they may be extending credit without providing the terms to customers 3) unauthorized funds withdraws from my account without an assigment of rights to do this, 4) I also have them on calling outside of the established hours of 8am-9pm (three calls well before 8am in my time zone.)

I know this is now a civil matter as the bank has refused to intervene and stand up for their customer. My questions are: 1) can any portion of this be filed in Small Claims Court or does that have to be filed in a federal district court?, 2) I know my actual damages are the fees plus the overdraft fees I incurred as a result of their actions, but are their statutory fees as well? 3) Is it called fraud or something else?

I spoke with one attorney very briefly, and he felt I could recover in a local court easily as the chances were since they are in PA and I am in AZ they wouldn't probably show up and I'd end up with a walk away judgement. He also won't take the case as there isn't enough in damages to constitute it... he's probably right on that point.

Thoughts? Feeback?
Erin

Credit Card closed for 3 years, Should I settle it?

I have 2 credit cards that were closed by the card company approx 3 years ago. I have been making on-time payments on them since they were closed, so my history looks good with them. I am now in a position to pay them off and wanted to find out if I settle them for less than is owed, will it lower my credit scores even though the accounts have been closed for some time now and I would assume the damage to my credit scores would have happened a while ago?

Any help is greatly appreciated!

Thanks

Please help, I am a beginner

Ok I am a true rookie to understanding my credit report. My question is, if a collection company buys a debt that is over seven years old can they add it back on to my credit report? NCO is listed on my account with a 9,830 debt that I can only assume is an old car loan. It was added on 12/2/09. How is that possible?

Dispute Nightmare

I sent Equifax a dispute letter about a charge-off account. Problem is, that negative account isn't on my Equifax report. I sent it to them by mistake. I meant to send it to Experian.
What will happen? Will they now take the initiative to "add" this negative item to my report, or ignore the dispute since that account isn't on the report?

And by the way, I have no negatives on my Equifax report at all. :x

JUDGMENT on Credit Report and Offer

I have some unpaid credit card debts stemming back 10 years ago and since receive the occasional 'collection letters' from various companies who bought off the credit card debts from the original credit card companies.

Most recently I just requested my credit report for the first time and found out from the credit report I have no "collections" actions, etc. but under Public Records, that I have a Judgment on my account filed 11/2005 with a local court and the fee amount of $7,000 from Plaintiff Credigy Receivables. Over the years I never received any notice from anyone regarding this. It may or may not be correct, so my first question is what should I do from here to get this resolved or even removed from my credit report?

The other question-today I received a letter from a Gryphon Solutions referencing the above Judgment and stating that they have the authority to resolve my account in full for $956. Is a fraud or is this legitimate, and what should I do, take the offer or find a lawyer??

Thanks for your time and replies
